Our Policy 

Stockr, Inc. (“Stockr”, “we”, “us” and/or “our”) owns and operates the https://stockr.com website (the “Site”). We provide services to you through the Site and those services, including any new features and applications, and the Site, are referred to collectively as the “Service,” and are subject to the following Privacy Policy, as amended from time to time.  This Privacy Policy sets forth Stockr’s policy with respect to personally identifiable data (“Personal Data”) and other information that is collected from users of the Service.  We reserve the right, at our sole discretion, to change or modify this Privacy Policy at any time without further notice.  Any such change or modification shall be effective immediately and you should regularly visit this page to review the current Privacy Policy so you are aware of any revisions.  We will post changes to this Privacy Policy on this page and will indicate at the top of this page the date these policies were last revised.  Your continued use of the Service after any such changes constitutes your acceptance of the new Privacy Policy.  If you do not agree with the terms of this or any future Privacy Policy, do not use or access (or continue to use or access) the Service.  It is your responsibility to regularly check the Service to determine if there have been changes to this Privacy Policy and to review such changes.

 

Information We Collect

When you use the Service, we may collect Personal Data and other information from you, as further described below:

 

            Personal Data That You Provide Through the Service: We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys, register for access to the Service or use certain parts of the Service. Wherever Stockr collects Personal Data we make an effort to provide a link to this Privacy Policy.

 

             Personal Data: Stockr collects Personal Data such as names, email addresses and telephone numbers to authenticate users and send users information related to the Service.

 

              Investment Portfolio Data: In connection with your use of the Service, you may choose to provide Stockr with investment portfolio data (“Portfolio Data”). Any Portfolio Data you provide to Stockr in connection with the Service will be accessible by Stockr and maintained in accordance with this Privacy Policy.  However, any Portfolio Data you identify as Portfolio Data to be shared (“Shared Portfolio Data”) will be displayed publicly on Stockr and through various third party social media platforms and you will have no right to privacy with respect to such Shared Portfolio Data.  You can turn off portfolio sharing at any time and thereafter any Portfolio Data subsequently provided through the Service will not be shared on Stockr or through third party social media platforms.  However, previously Shared Portfolio Data will be available to others in the Service’s archives and Shared Portfolio Data shared previously shared through third party social media platforms will remain accessible to others.   If you decide to provide Portfolio Data, we may be able to obtain other types of related information about you.  Additionally, whether or not you choose to display Portfolio Data publicly, we may obtain information about you or your portfolio.  For example, if you decide to participate in a stockholder discussion held by a participating company and hosted through the Service, we may access your portfolio, with your permission, to confirm you are a stockholder of the company and permit you access to the stockholder discussion.  Any information we obtain from you or others about your portfolio and that you do not identify as Shared Portfolio Data will not be shared and will be subject to this Privacy Policy.  Stockr cannot control and shall not have any responsibility for any actions that users and other third parties take with respect to your Shared Portfolio Data.

 

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to the Service, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Stockr and the authorized third parties referred to herein located in the United States.

 

            Other Information:

 

                        Non-Identifiable Data: When you interact with Stockr through the Service, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. Stockr may store such information itself or such information may be included in databases owned and maintained by Stockr affiliates, agents or service providers. The Service may use such information and pool it with other information to track, for example, the total number of visitors to the Service, the number of visitors to each page of our Service, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.

 

                        Cookies:  In operating the Service, we may use a technology called "cookies." A cookie is an alphanumeric identifier that the computer hosting our Service gives to your web browser when you access the Service. Our cookies help provide additional functionality to the Service by enabling our systems to recognize your browser and help us analyze Service usage more accurately. For instance, our Service may set a cookie on your browser that allows you to access the Service without needing to remember and then enter a password more than once during a visit to the Service.                         Aggregated Personal Data: In an ongoing effort to better understand and serve the users of the Service, Stockr often conducts research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Stockr may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. Stockr may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

 

Our Use of Your Personal Data and Other Information 

            Generally: Stockr uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by e-mail, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data in order to obtain access to the Service, we will use your Personal Data to provide you with access to the Service and to monitor your use of the Service.

Profile and Page Information:  Stockr allows other users to browse your user name and any other profile details, should you provide this optional information.  Stockr allows other users to view companies you track, your comments, photos and/or videos you upload, blogs you post, and any other material you make publicly available on the Service.

Social Networking Services: Stockr uses Facebook Connect and OAuth for Twitter to give you the option to post information about your activities on the Service to your profile page, to share with others within your network and to invite friends to join the Service.  In addition, Stockr maintains its own presence on social media services, including, without limitation to, Twitter.  By using the Service, you acknowledge and agree that Stockr may share information on social media services about your activity on the Service and the content that you create while using the Service.  If you wish to opt-out of permitting Stockr to share information about your activity on the Service and/or your user-generated content in a manner that identifies you individually please contact us at: customerservice@stockr.com.

Data Analysis and Service Improvement: Stockr may also use your Personal Data and other personally non-identifiable information collected through the Service to help us improve the content and functionality of the Service, to better understand our users and to improve the Service.

Contacting You: Stockr may use your contact information to contact you in the future to tell you about services we believe will be of interest to you. If we do so, each communication we send you will contain instructions permitting you to "opt-out" of receiving future communications. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.

Additional Uses of Personal Data: If Stockr intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

 

Our Disclosure of Your Personal Data

We may share your Personal Data with certain third parties without further notice to you, as set forth below: 

            Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

            Related Companies: We may also share your Personal Data with our Related Companies for purposes consistent with this Privacy Policy.

            Agents, Consultants and Related Third Parties: Stockr, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

API: Stockr will provide third parties access to all Stockr data that is already publicly available through the Service. Stockr will keep private passwords, settings and other Personal Data in our database, and in those of third parties whose technologies are integrated with the Service.

            Social Networking Services:  Stockr may share information regarding activity on the Service on Social Media Services as described in this Privacy Policy.           

            Legal Requirements: Stockr may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Stockr, (iii) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (iv) protect against legal liability.


Your Choices

You may choose not to provide certain Personal Data that we request, but in doing so, you may be unable to take full advantage of the Service.  You can access parts of the Service without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain parts of the Service.

 

Exclusions 

This Privacy Policy does not apply to any Personal Data collected by Stockr other than Personal Data collected through the Service. This Privacy Policy shall not apply to any unsolicited information you provide to Stockr through this Service or through any other means. This includes, but is not limited to, Shared Portfolio Data, comments and other information that you post to any publicly accessible areas of the Service (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Stockr shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

 

Children

Stockr does not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, you are not authorized to use the Service and please do not submit any Personal Data through the Service. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Service without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to Stockr through the Service, please contact us, and we will endeavor to delete that information from our databases.

 

Links to Other Web Sites 

This Privacy Policy applies only to the Service. The Service may contain links to other web sites not operated or controlled by Stockr (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from this Service do not imply that Stockr endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

 

Security

Stockr takes reasonable steps to protect the Personal Data provided via the Service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from the Service may not be secure. Therefore, you should take special care in deciding what information you send to us via e-mail. Please keep this in mind when disclosing any Personal Data to Stockr via the Internet.

Changes to Stockr’s Privacy Policy

The Service and our business may change from time to time. As a result, at times it may be necessary for Stockr to make changes to this Privacy Policy. Stockr reserves the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any Personal Data. This Privacy Policy was last updated on the date indicated above. Your continued use of the Service after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

 

Access to Information; Contacting Stockr

You can access your Personal Data on the Service and correct, amend, or delete information that is inaccurate. As stated previously, you may opt-out and choose not to disclose Personal Data, but as a result, you may be unable to use certain features of the Service.

Stockr will retain your Personal Data for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your Personal Data to provide you services contact us at customerservice@stockr.com. Stockr will retain and use your Personal Data as necessary to comply with our legal and our regulatory compliance obligations, to resolve disputes, and to enforce our agreements.
